Requirements For Use

Every customer must be at least eighteen (18) years of age in order to conduct business with Sell Gold. In addition, every customer of Sell Gold must be the actual owner of any and all property sold or attempted to be sold to Sell Gold, and every customer must be acting on his or her own behalf and not as the agent or representative of another person. Sell Gold may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.

Guarantee Against Loss

Sell Gold will guarantee against loss of the total contents properly shipped to Sell Gold in a Sell Gold Kit in accordance with the instructions and procedures established by Sell Gold and subject to the terms and conditions displayed at SellGold.com. If the total value of your items is greater than $100, we recommend that you insure your package. If you choose to do this, Sell Gold will reimburse you the cost of the insurance.

Sell Golds liability will be limited to one-third (1/3) of the value of the total content, or One Hundred ($100.00) Dollars, whichever is less. If there is no original sales slip or appraisal, Sell Golds liability will be limited to Twenty ($20.00) Dollars. If there is an original sales slip or appraisal, Sell Golds liability will be limited to One Hundred ($100.00) Dollars as set forth herein above.

This Guarantee shall apply only to merchandise shipped in the Tyvek packaging supplied by Sell Gold.

Sell Gold reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package which appears to be damaged, opened, or tampered with and any such mail, envelope or package will be returned by the post office to the customer.

Sell Gold shall have no liability to any customer for any such attempted delivery or return of any such items.

Limitation Of Liability

This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer’s successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer’s transaction with Sell Gold.

In no event shall Sell Gold be liable to any third party, including any insurance carrier. Sell Gold shall not be liable for any subrogation claim brought by customer’s insurance carrier, and, by submitting an item to Sell Gold, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

Sell Gold's liability is and shall be expressly and specifically limited to the LEAST of the following sums:

1. The liquidation value placed on the total contents by Sell Gold in Sell Gold's sole discretion;

2. One third (1/3) of the appraised value of the contents according to an appraisal submitted by a customer/seller to Sell Gold, which appraisal was issued prior to the shipment of the item to Sell Gold; and,

3. The sum of One Hundred ($100.00) Dollars.

The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents being submitted to Sell Gold, Sell Gold's liquidated value shall be conclusive and binding and further, that in no event shall Sell Gold's Liability exceed One Hundred ($100.00) Dollars.

Sell Gold shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above.

By submitting the item, customer explicitly and expressly accepts this limitation of liability.

Verbal Offers

Any customer or prospective seller may request Sell Gold to provide a telephone or e-mail quote for his or her items after such items have arrived at Sell Gold’s processing facility. Verbal offers may, at the discretion of Sell Gold, be recorded. Upon a verbal acceptance by the customer of the telephone or e-mail quote, payment will be issued by Sell Gold within twenty four (24) hours of such acceptance, and the ten (10) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

What You Win

SellGold.com is giving away a seven (7) night stay at the Sandcastle Resort in Myrtle Beach, SC. The time of travel will be chosen by the winner and is based on availability of the resort . The winner must travel seven (7) consecutive days within one year of 9/5/2009 or from 9/5/2009 to 9/5/2010. The winner is responsible for transportation to Myrtle Beach, SC. Transportation is not included in the give-away. The winner is entitled to seven (7) consecutive nights at the Sandcastle Resort. The room is ocean front, maximum four (4) person capacity, including an efficiency kitchen, balcony and 2 queen beds. The winner will be held responsible for any damage done to the room during their stay at the resort. The vacation is a $1,400 value. SellGold.com is in no way associated with Sandcastle Resort. Contest Entry

To be entered to win one must be twenty-one years old (21) or older and send unwanted gold to SellGold.com for evaluation and payment. Once the gold is received, no matter the value, the individual is automatically entered into the vacation give-away drawing. One can also be entered into the vacation give-away drawing by completing the entry form and mailing it to Attn: SellGold.com Vacation Give-Away 2437 N Church St Burlington NC 27217 by 9/5/2009.

Random Drawing

A random drawing will take place on 9/5/2009. The winner will be contacted that day by a SellGold.com representative. The winner will be notified of their prize and given one week to choose travel dates. If travel dates are not communicated to SellGold.com within one month of the drawing or 10/5/2009 another winner will be randomly chosen. SellGold.com will make arrangements with the Sandcastle Resort on behalf of the winner. The winner will receive confirmation of the travel dates and resort booking confirmation. If for any reason the winner cannot go on the vacation on the chosen dates due to unforeseen circumstances, SellGold.com is not responsible for re-booking. The odds of winning are based on the number of people who send in their gold and enter.
